Welcome to BYTHORNAM.COM. When completing a purchase on this website, you will automatically accept following terms and conditions. We advise you to read them thoroughly before you purchase any of our items. We would like to point out that shopping at BYTHORNAM.COM requires you to be at least 18-years-old.

SHIPPING/DELIVERY
We ship worldwide – from our production facilities right to your doorstep. Headboards are not a stock item and shipping date is usually 3-4 weeks from order date. All hooks, rings and samples are stock orders and are shipped within a week from order date. Shipping charges vary depending on shipping destination. BY THORNAM is a Danish company based in Denmark. We offer free shipping on orders within the borders of Denmark. Shipping to countries outside Denmark are calculated in our webshop. If our shipping provider do not deliver to your destination we reserve the right to cancel your order. If shipping costs exceeds 1600kr/200GBP/220EURO/260USD we also reserve the right to cancel your order.

TRANSPORT/PRODUCT DAMAGES UPON ARRIVAL
In the event of the carboard boxes being damaged upon arrival you need to cancel the delivery (return to sender) and inform us within 5 workdays. After that the product is your responsibility. In case of obvious product errors or damages you also have 5 workdays to file a complaint at info@bythornam.com.

PAYMENT
The products we make are not stock products. They are customized according to every customer’s specific needs (size, material, combination). Therefore, we charge the full order amount within 7 days of the order confirmation.

In the event of order cancellation (7 days from order date) or product return, 40% of the full invoice amount is non-refundable.

At BYTHORNAM.COM we accept payment from the following creditcards: MasterCard, Visa, American Express.

SAFETY
All communication between our payment system and the cardholder takes place via an encrypted SSL-connection (Secure Socket Layer). Only PBS has access to your data. Neither BY THORNAM nor other unauthorized people have access to your data. At BYTHORNAM.COM your personal contact information is 100% confidential and we guarantee that nobody else will be able to access them.

DUTY & VAT
When placing an order from an EU-country you must pay Danish VAT. When placing an order from countries outside EU you do not pay VAT, but you are responsible for the payment of local taxes and customs clearances at delivery.

Products withheld by customs in your country must be cleared by you within 3 workdays after they have notified you of package arrival. If they are not cleared within this timeframe your right of order cancellation or making a product/transport damage complaint is withdrawn. If we have to resend a product that has been returned by customs you will be charged for shipping again.

RIGHTS OF CANCELLATION
In the event of order cancellation (7 days from order date) or product return, 40% of the full invoice amount is non-refundable. BYTHORNAM.COM offers a 14 day-period right of cancellation upon delivery. The right to return your order ends 14 days after you have:

  1. Received your order.
  2. Received the last part of your order (in case of ordering several items in the same order that are delivered separately)
  3. Received the last part of your order (in case of ordering an item that consists of several parts)

If you wish to cancel your order, it is your responsibility to notify BYTHORNAM.COM, within 14 days upon reception of your items. Notice must be given via e-mail to info@bythornam.com. In this e-mail it must be clearly stated that you wish to use your right of cancellation. It is not possible to use the right of cancellation by simply refusing reception of your items. Please note that you will get 60% of the full invoice amount in return if you withdraw your order.

SALE
We do not reimburse the price difference on orders made before a sale.

RETURNS
When returning an order, the customer is responsible for sending back the items no later than 14 days after having informed us of the cancellation. Furthermore, the customer is fully responsible for all costs that may emerge in returning of the goods. When returning an item, the customer is expected to pack the items securely. And in addition, the customer is responsible for the condition of the product from the point of delivery until we receive it at our address.

If the shipment is returned, due to not releasing the product(s) from customs, shipments fees for returning them to us is deducted the 60% of the full invoice amount (see cancelation section).

You must enclose a copy of the order of confirmation and your invoice.

Please note that we do not receive packages sent per COD.

THE CONDITION OF THE PRODUCT BY RETURN
The items must be in the exact same condition as when the customer received it.

The item can be tested and the customer is only liable for any diminishing value of the item, which is caused by handling the item other than necessary to determine its nature, characteristics and the way it works.

If the product has been used in addition to what is described above, it will be considered as used, which could mean that you only will be reimbursed partly or not at all depending of the item’s commercial value.

REIMBURSEMENT
If you should regret your purchase on our website, you will be fully reimbursed within the first 7 days from order date. After 7 days from order date 40% of the full invoice amount is non-refundable. In case of a depreciation caused by the customer, this will be deducted from the refunded amount.

The reimbursement will happen maximum 5 working days after order cancellation or we received the item.

WARRANTY
BYTHORNAM.COM offers a 24-months-period of warranty on all of our products. Throughout this period, you can either get your item repaired, swapped, be reimbursed or receive a discount, depending on the specific case.

The claim will only be considered as eligible if the item’s defect is not caused by either misuse of the product or other injurious behaviour.

You must make the complain within reasonable time after you have discovered the defect in the product. If you file your complaint within two months after the defect is discovered, the claim is always timely.

Please note that we do not receive packages sent per COD.

All freight charges must be payed by customer.

FAILURE TO MAKE PAYMENT
Reminder fee is 100 DKK per month overdue. On the 3. reminder debt collection will be done through our lawfirm Kromann Reumert.

APPLICABLE LAW AND DISPUTES
The present trading conditions are subject to Danish law. Dispute pursuant to the tender conditions / terms and conditions shall be settled in Denmark, since this is where the company is domiciled, and from where all trades are executed.
